PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING OUR WEBSITE OR PLACING AN ORDER. THEY INCLUDE DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY (SECTIONS 14 AND 15).

The website reflectandroam.com, including its pages, emails and related services (the "Website"), is owned and operated by Crafts and creations BV, a company registered in Belgium under enterprise number BE0741.500.761, with its registered office at Tolstraat 13, 2000 Antwerpen, Belgium ("Reflect and Roam," "we," "our," "us"). We offer the Website, including all information, tools, products and services on it, on the condition that you accept these Terms and the policies they refer to. By using the Website or placing an order, you agree to these Terms. If you don't agree, please don't use the Website.

THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 16). THIS MEANS THAT, UNLESS YOU OPT OUT, DISPUTES WILL BE RESOLVED BY INDIVIDUAL ARBITRATION INSTEAD OF IN COURT, AND YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. SECTION 16 EXPLAINS HOW TO OPT OUT.

You can always find the latest version of these Terms on this page. We may update, change or replace any part of these Terms by posting a new version here. Changes apply to orders placed after the new version is posted. Your continued use of the Website after changes are posted means you accept them.

1. Using the Website

By using the Website, you confirm that you are at least the age of majority in your state of residence and that you can legally enter into a binding contract with us.

2. Privacy

Our Privacy Policy explains how we collect and use your personal information. It is part of these Terms.

3. Rules for using the Website

All content on the Website is protected by US and international copyright, trademark and other intellectual property laws. Using the Website doesn't give you ownership of any of it.

You agree not to use the Website for any unlawful purpose, including: (1) hacking or attacking the Website; (2) posting abusive, obscene, defamatory or discriminatory material; (3) encouraging others to break the law; (4) violating any law or regulation; (5) infringing our intellectual property rights or those of others; (6) harassing, threatening or discriminating against anyone; (7) submitting false or misleading information; (8) uploading viruses or other harmful code; (9) collecting or tracking other people's personal information; or (10) getting around the Website's security features.

We may refuse or end your access to the Website if you break these Terms, give us false information, or act in a way that harms us, our customers or the Website.

4. Personal use only

Products bought on the Website are for your personal, non-commercial use. You agree not to resell them. We may limit or cancel orders that, in our reasonable judgment, appear to be placed by resellers or distributors. Products resold outside our store may not be covered by our guarantee.

5. Safe use of our products

Our reflective products are designed to make you and your dog easier to see when light, such as car headlights, shines on them. They are a visibility aid, not a guarantee of safety. Reflective material only works when light hits it, and how well drivers see you depends on things like distance, angle, weather, lighting and the driver's attention. Always follow traffic rules, use crosswalks, stay alert and keep your dog under control.

Choose a leash that suits your dog's size and strength. Check the leash, clip and stitching regularly for wear or damage, and stop using it if it's damaged. Our leashes are not chew-proof: never leave your dog alone with the leash attached. Always supervise your dog while it's on the leash.

6. Accuracy of information

We do our best to keep the information on the Website accurate and up to date. Still, the Website may sometimes contain errors or omissions in product descriptions, prices, promotions, shipping costs, delivery times or availability. We may correct errors, update information or cancel orders based on incorrect information at any time, also after you've placed your order. If we cancel your order, we'll refund you in full.

We try to show product colors and images as accurately as possible, but we can't guarantee that your screen displays them exactly.

7. Changes to the Website and prices

We may change, suspend or stop any part of the Website at any time. Product descriptions and prices may change without notice. A price change never affects an order you've already placed. Some products may be available in limited quantities. Returns and refunds are handled according to our Shipping Policy and Refund Policy. Any offer on the Website is void where prohibited.

8. Payment and sales tax

All prices are in US dollars (USD). Prices don't include sales tax. Where applicable, sales tax is calculated and added at checkout based on your shipping address.

By paying, you confirm that: (i) you are authorized to use the payment method; (ii) the payment information you give is complete and accurate; and (iii) there are enough funds to cover the payment. Payments are processed by our third-party payment providers. They may receive updated card details from your card issuer, for example when your card expires. We aren't responsible for fees charged by your bank or card issuer. If a payment is reversed, we may ask you to pay by another method.

9. Orders

Your order confirmation email confirms that we received your order. It doesn't yet mean we've accepted it. We accept your order when we ship it. We may refuse or cancel any order, for example if a product is out of stock, a price was wrong, or we suspect fraud. If we cancel your order, we'll refund you in full to your original payment method. We may ask for more information before processing an order.

10. Shipping

We ship to addresses in the United States only. Shipping is free on orders of $45 or more; orders under $45 have a $4.95 shipping fee. Orders usually ship within 2–4 business days and arrive 3–7 business days after that. See our Shipping Policy for details. We'll email you a tracking number when your order ships.

Please enter a correct shipping address and phone number at checkout. We're not responsible for late or missing deliveries caused by an incorrect address. Made a mistake? Email us right away at info@reflectandroam.com. We'll do our best to change or cancel your order, but once it has shipped we can't change it.

11. Delivery confirmation

You agree that the carrier's delivery confirmation is sufficient proof of delivery, even without a signature. See our Shipping Policy for what to do if a package is marked delivered but you can't find it, or if it's lost in transit.

12. Returns and refunds

Our 30-day money-back guarantee, returns, and damaged or defective products are covered in our Refund Policy. All sales are final after 30 days from delivery. Once we receive and approve a return, refunds usually take 5–10 business days to process, and it may take a few more days for the refund to show on your statement, depending on your bank. We're not responsible for returns lost on their way to us, so we recommend using a tracked shipping method.

13. Social media

This section applies when you interact with our pages on social media platforms such as Instagram, Facebook, TikTok, YouTube or Pinterest. These platforms aren't controlled by us and have their own terms and privacy policies. Comments posted by others are their own opinions, not ours. If you see an offensive post or comment, please report it to the platform.

14. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN OUR REFUND POLICY (INCLUDING OUR 30-DAY MONEY-BACK GUARANTEE AND OUR PROMISE TO REPLACE OR REFUND DAMAGED OR DEFECTIVE PRODUCTS), AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES. WHERE THE LAW DOESN'T ALLOW IMPLIED WARRANTIES TO BE EXCLUDED, THEY ARE LIMITED TO 30 DAYS FROM DELIVERY. SOME STATES DON'T ALLOW THESE EXCLUSIONS OR LIMITATIONS, SO THEY MAY NOT APPLY TO YOU, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REFLECT AND ROAM AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS, THE WEBSITE OR OUR PRODUCTS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR ANY OTHER THEORY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. IF WE ARE FOUND LIABLE ANYWAY, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, SUCH AS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FOR FRAUD. SOME STATES DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

16. Dispute resolution: binding arbitration and class action waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH INDIVIDUAL ARBITRATION.

Talk to us first. Most problems can be solved quickly. Before starting arbitration, please email us at info@reflectandroam.com with a description of the issue and give us 30 days to try to resolve it.

Arbitration. If we can't resolve it, you and we agree that any dispute or claim arising from or relating to these Terms, our Privacy Policy, our marketing, the Website or our products will be resolved by binding, individual arbitration before a single arbitrator, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act (9 U.S.C. §§ 1–16) governs this section. The arbitrator will apply the laws of Belgium, to the extent consistent with the Federal Arbitration Act, without depriving you of the protection of mandatory consumer laws of the US state where you live, and may award any relief that a court could award on an individual basis. Either party may instead bring an individual claim in small claims court if it qualifies.

Class action waiver. Claims may only be brought on an individual basis, not as a plaintiff or class member in any class, consolidated or representative proceeding. The arbitrator may not combine claims of different people. If any part of this section is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court, and all other claims will still be arbitrated.

Unless you opt out, you give up the right to: (a) have a judge or jury decide your claim; (b) take part in a class action; and (c) join your claim with anyone else's.

Opting out. You can opt out of this arbitration agreement within 30 days of your first purchase by emailing info@reflectandroam.com with the subject line "Arbitration Opt-Out," including your name, order number and a clear statement that you want to opt out of arbitration. Opting out doesn't affect any other part of these Terms.

Despite the above, we may bring a claim in court to protect our intellectual property rights.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Reflect and Roam and its owners, employees, contractors, agents, suppliers and service providers from any claims, damages, losses and costs (including reasonable attorneys' fees) arising from: (1) your breach of these Terms; or (2) your violation of any law or the rights of a third party.

18. Third-party websites and links

The Website may include content from or links to third-party websites. We aren't responsible for their content, products or practices. Please review their terms and policies before using them. Questions or complaints about third-party products should go to that third party.

19. Reviews, photos and other submissions

We love hearing from you. When you send or post reviews, photos, videos, comments, ideas or suggestions to us or tag us on social media with the intent that we use it ("Submissions"), you confirm that your Submission is honest, reflects your own experience, and doesn't infringe anyone else's rights. You give us a non-exclusive, royalty-free, worldwide, perpetual license to use, copy, display, publish, adapt and share your Submission, together with the name you provided, on the Website, on social media and in our marketing. We'll ask for your permission before using a photo or video from your own social media account. We publish honest reviews, positive and negative, and we never pay for or reward positive reviews without clearly saying so.

20. Intellectual property and copyright complaints

Our content. All content on the Website, including text, photos, videos, graphics, logos, designs and software (the "Content"), is owned by or licensed to Reflect and Roam and protected by US and international intellectual property laws. You may view the Content for personal, non-commercial use only. You may not copy, reproduce, distribute, sell, modify or create derivative works from the Content without our written permission.

Trademarks. Reflect and Roam, NightSight and our logos are trademarks of Crafts and creations BV. You may not use them without our written permission. Other trademarks shown on the Website belong to their respective owners.

Copyright complaints. If you believe content on the Website infringes your copyright, email us at info@reflectandroam.com with: (i) a description of the copyrighted work; (ii) a description of the infringing material and where it is on the Website; (iii) your name, address, phone number and email address; (iv) a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; (v) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (vi) your physical or electronic signature. We'll investigate and remove infringing material where appropriate.

21. Electronic communications

You agree that we may communicate with you electronically, such as by email or through the Website, and that these communications satisfy any legal requirement that they be in writing.

22. Assignment

You may not transfer your rights under these Terms. We may transfer our rights and obligations under these Terms if all or part of our business is transferred to another company, for example through a merger or sale.

23. No waiver

If we don't enforce a part of these Terms, that doesn't mean we give up our right to enforce it later.

24. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be enforced to the extent allowed by law, and the rest of these Terms will remain in full effect.

25. Termination

These Terms apply until ended by you or us. You can end them by no longer using the Website. If these Terms end, sections 2–6, 12–20 and 22–26 continue to apply.

26. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy and any other policies posted on the Website, are the entire agreement between you and Reflect and Roam about the Website and your purchases, and replace any earlier agreements.
